Subscriptions, credits, payment, withdrawal and termination

This translation is provided for convenience. In case of discrepancy, the French version prevails.
1. Seller and scope
These CGV (conditions générales de vente) apply to any subscription to a plan or purchase of credits on Pecunnia, sold by Matis Bocaccio EI, nom commercial Pecunnia AI, RCS Paris 132 014 788, 47 rue Vivienne, 75002 Paris, SIRET 132 014 788 00013 (“the Publisher”) to a consumer customer (“you”). They supplement the CGU.
2. Plans
Pecunnia offers two plans — Start and Pro — each available either as a monthly subscription, with no minimum term, or as a yearly subscription, with a one-year commitment (article 2a). Prices are stated in euros, net. VAT not applicable, article 293 B of the French General Tax Code (“TVA non applicable, art. 293 B du CGI”): the Publisher is a VAT-exempt small business, no VAT is charged and the price shown is the price paid; the statement appears on the payment page, on the invoice and on the receipt.
- Start — … per month, or … per year: access to the Service and … assistant credits included each month.
- Pro — … per month, or … per year: access to the Service and … assistant credits included each month.
The yearly price corresponds to ten monthly payments: two months are free compared with the monthly plan.
The prices displayed at the time of the order, on the payment page, are the only ones applicable.
2a. Yearly plan
- Commitment: the yearly subscription is concluded for a fixed term of one year from its subscription (or from the switch to yearly, article 7).
- Payment: the yearly price is paid in one go, at subscription, for the twelve months of the period.
- Credits: the included assistant credits (Start and Pro) are allocated each month of the yearly period, in the monthly amount in force at the start of the yearly period, throughout that period. Those not used at the end of a month are not carried over and expire. The usage cap for each month is that of the credits included for that month.
- Renewal: at its term, the yearly subscription is renewed for one year by tacit renewal (tacite reconduction); a written reminder is sent to you by e-mail 45 days before the term (within the legal period of three months to one month before the term), with the option not to renew it (art. L. 215-1 of the French Consumer Code (code de la consommation)).
- Termination: you may request termination at any time; it takes effect at the end of the current yearly period, until which you keep access. No refund of the yearly period is due after the withdrawal period has expired (article 9).
3. Free trial
3.1. Any first subscription to a Start or Pro plan, monthly or yearly, begins with a free trial period of seven (7) days. You subscribe on the secure payment page of our provider Stripe, where you register a bank card; no amount is charged during the trial period.
3.2. During the trial, you have access to the whole Service, except the features that consume AI credits (the conversational assistant “AI chat” and the AI recap of your favourites). No AI credit is allocated during the trial: the credits included in your plan are added at the first payment.
3.3. Unless you cancel before the end of the trial, the subscription continues automatically and the first payment is charged to the registered card at the end of the seven days, on the date and for the amount shown on the payment page and in the subscription confirmation e-mail (monthly plan: the monthly price, then every month; yearly plan: the yearly price, for a one-year commitment from the first payment).
3.4. You may cancel the trial at any time before it ends, from your Account page (“Cancel trial”), free of charge and without giving reasons: no payment is then taken and your access ends at the end of the trial. You may also end the trial early (“Activate now”): the first payment is then charged immediately and the included credits are added (article 9 for withdrawal).
3.5. The free trial is granted only once per person. It is refused if the account, the e-mail address or the bank card has already had a trial; in that case, the payment page says so and the subscription starts without a trial, with an immediate first payment. If the card entered has already been used for a trial, the trial is not opened, no amount is charged and you may subscribe without a trial.
3.6. If the first payment fails, access to the Service is suspended; Stripe may retry the payment over a few days, after which the subscription is terminated if it remains unpaid (article 11).
4. Order, payment, invoice
The order (the subscription) is concluded when you confirm Stripe's secure payment page. For a first subscription, the first payment is due at the end of the free trial (article 3); without a trial, at the time of the order. It is then due at each due date — monthly or yearly depending on the plan —, by bank card. Pecunnia stores no card number. An order confirmation is sent to you by e-mail; each invoice is sent to you by e-mail and remains downloadable from your Account page (“Manage my payment and invoices”).
5. Credits
Credits measure use of the assistant: each answer consumes a number of credits equal to its actual processing cost, shown after the answer. No cost amount in euros is charged per question.
- Start and Pro: included credits are allocated for each paid monthly period — on the yearly plan, each month of the yearly period (article 2a). Those not used at the end of the month are not carried over and expire, including if the subscription is not renewed. The usage cap for the month is that of the included credits, plus any purchased credits;
- Top-up (Start and Pro): you buy credits on a pay-as-you-go basis, reserved for active subscribers. The number of credits obtained is the top-up amount, less a commission of … and payment fees (…), converted into dollars at the European Central Bank reference rate of the day, at one credit per $… (rounded down); it is shown before payment and credited as shown. A refund removes credits in proportion to the amount refunded. Purchased credits remain valid for … from the purchase, including if you terminate your subscription before then;
- before each question, a credit reserve (shown in “My credits”) is set aside from your balance, up to that balance: if your balance is below the estimated cost of the question, the answer is written within your balance; below a minimum, the question is not asked and nothing is charged. After the answer, its full actual cost is charged and the rest of the reserve is returned to you; if, exceptionally, that cost exceeds the reserve, the difference is also charged;
- a change in the number of credits included in a plan never applies to a period already paid for: credits already allocated remain yours until the end of that period, and the new amount takes effect at your next renewal (for the yearly plan, at the next yearly period);
- credits have no monetary value, are not refundable in cash and are not transferable, unless otherwise provided by law.
6. Term, renewal, reminder
The monthly subscription is renewed by tacit renewal (tacite reconduction) for periods of one month until terminated. The date and amount of the next payment are shown on your Account page.
The yearly subscription is renewed by tacit renewal for periods of one year, after the written reminder provided for in article 2a.
7. Change of plan
You can change plan from your account area; the invoicing terms of the change are displayed before confirmation:
- switching from monthly to yearly: immediate. The yearly price is invoiced on the day of the switch, less the unused part of the current month; the yearly period and the one-year commitment start on that day;
- switching from yearly to monthly: at the end of the current yearly period;
- switching from Start to Pro or from Pro to Start, monthly or yearly: at the end of the current period, with no partial invoicing.
A scheduled change can be cancelled as long as the current period has not ended.
8. Termination
You can terminate at any time, online, from your account area, without charge or notice, and cancel the termination as long as the current period has not ended. The termination takes effect at the end of the period already paid: you keep access until that date and nothing is charged afterwards. Unused included credits expire on that date (article 5). No refund of the current period is due, unless otherwise provided by law or in the event of exercise of the right of withdrawal. On the yearly plan, the current period is the committed year: termination takes effect at its end (article 2a).
9. Right of withdrawal (droit de rétractation)
You have 14 days from the subscription to withdraw, without giving any reason (art. L. 221-18 of the French Consumer Code (code de la consommation)), by writing to contact@pecunnia.com or by using the form below.
The contract is concluded on the day of the subscription, at the start of the trial period. The fourteen (14)-day withdrawal period runs from that date. During the trial, since no amount is charged, cancelling the trial is enough. If you end the trial early (“Activate now”), you expressly request immediate performance of the Service: if you withdraw within fourteen days of the subscription, the first payment is refunded to you less an amount proportionate to the period of use since that payment. If the first payment was charged automatically at the end of the trial, it is refunded to you in full if you withdraw within the same period. The refund is made within fourteen days of your request.
Withdrawal form
To Matis Bocaccio EI, nom commercial Pecunnia AI, RCS Paris 132 014 788, 47 rue Vivienne, 75002 Paris, SIRET 132 014 788 00013 (contact@pecunnia.com):
I hereby give notice that I withdraw from the contract for the following subscription: plan: …………………, ordered on: ………………….
Name: — E-mail address of the account: — Date: — Signature (if notified on paper):
10. Refund
In the event of withdrawal, you are refunded no later than 14 days after the Publisher has been informed of your decision, using the means of payment used for the order, according to the rules of article 9. The subscription ends on the date of withdrawal and the remaining credits are removed.
11. Payment failure
If a payment fails, access to the paid features is suspended from that first failure and you are informed by e-mail. Stripe automatically retries the payment up to eight times during the fourteen days following the due date (about every two days); at any time you can update your card and settle the invoice from your Account page (“Manage my payment and invoices”), and access is restored as soon as payment is made. If no attempt succeeds, the subscription is terminated at the end of those fourteen days.
12. Changes to prices and to the CGV
The Publisher may change its prices or these CGV for the future. Any change is notified to you by e-mail at least thirty (30) days before it enters into force; you may terminate your subscription free of charge before that date. A new price only applies to due dates after it enters into force; for the yearly plan, it applies at the next renewal, never to the current yearly period.
13. Complaints, mediation, applicable law
Any complaint should first be sent to contact@pecunnia.com. After a written complaint that has not received a satisfactory answer, you may refer the matter free of charge to the consumer mediator (médiateur de la consommation). The CGV are governed by French law; the French courts have jurisdiction, subject to the protective rules applicable to consumers.
